Your Role and Responsibilities
In Canada, the legal team is centered in Markham, Ontario, at the IBM Canada headquarters. The team provides legal support in several core areas including employment & benefits, intellectual property, privacy, information technology, general commercial, procurement,
The Staff Counsel is responsible for assisting, with minimal direction, other attorneys at the corporate, division or business unit level and act as a consultant to senior management on all Employment and Benefit related legal matters.
The successful candidate would be involved in tasks such as reviews, interprets and counsels on federal, provincial and local employment and benefit laws, agency rulings, IBM policies and practices, business conduct and ethics. Drafts and reviews agreements, contracts and other employment and benefit related documents. Assumes additional responsibilities as assigned.
Must have obtained a JD/LLB degree plus be admitted to at least one provincial bar. Requires professional legal mastery in all employment and benefits, including pension, legal areas including but not limited to: regulatory law, contracts, case law, vital pending legislation, etc. prepares/implements corporate-wide instructions for proper implementation of the court decisions or legislation affecting the business operations of the IBM Canada.
Advises management on the legal / ethical aspects arising from day-to-day employment and benefit matters. Required on an as needed basis to assist with negotiations / communications with external legal agencies / representatives, outside counsel, benefit providers, employees (and their representatives) with respect to employment and benefits matters including disputes. This may include the management of employment and benefit litigation matters.
Has the facility to assist with the management of complex claims against the company, and assists with the preparation for negotiation, litigation or arbitration proceedings to resolve controversies, including the coordination of efforts by corporate staff and outside counsel. Contributes to the development of ongoing and future strategies to avoid potentially damaging legal situations regarding employment and benefit matters.
Provides expertise in employment and benefits law and related governmental activities to management throughout the company. Provide advice and counsel to all levels of management as necessary.
Required Technical and Professional Expertise
Employment law expertise required with 7 to 10 years of experience as a sole practitioner or an in- house staff counsel
Must have obtained a JD/LLB degree plus be admitted to at least one provincial bar
Qualified to practice law in Canada, preferably in Ontario
Excellent written and verbal communication skills
Excellent organizational skills, with the ability to work well under pressure
Ability to handle tight deadlines, multiple projects and a high volume of paperwork
Confident and dependable, with strong initiative and ability to work both independently and in a team oriented atmosphere. Fast learner and ability to pick up new technology and tasks quickly
Preferred Technical and Professional Expertise
French language skills would be an asset
Previous experience working for a Global IT organization
