About The Role
Reporting to the Director, Regulatory and Product Compliance, the Senior Manager, Product Compliance will undertake day-to-day compliance activities related to the Product Compliance business unit.
Product Compliance encompasses Mutual Funds, ETFs, 40 Act Funds and Pooled Funds products distributed to both retail and institutional clients in multiple global jurisdictions. The position includes management and mitigation of compliance risk in the areas of Marketing/Sales Communications, Sales Practices, AML/ATF, Operations Oversight, Privacy, Complaints, Market Conduct, etc.
Assist the Director in maintaining an up-to-date inventory of regulatory compliance risks applicable to the operations of Product Compliance, maintain adequate internal controls, and provide advice to business unit stakeholders on regulatory compliance matters. This includes, but is not limited to:
Effectively managing staff to ensure all deadlines are met while maintaining fair workload distribution and a positive culture; training and coaching, as required.
Reviewing marketing and sales materials to ensure compliance with market conduct and regulatory requirements (including website content, product profile sheets, sales presentations, video commentaries, etc.).
Sourcing and researching complex legislation, regulations, industry guidelines and corporate requirements.
SupportIng the creation and implementation of compliance programs for all products, including policies, procedures and testing.
Identifying compliance risks and areas of potential non-compliance; proposing and implementing action plans and controls to mitigate risk and maintain oversight.
Assisting the Director in resolving escalated regulatory compliance issues in a timely manner.
Keeping abreast with regulatory changes, reports and staff notices issued by regulators and updating policies, procedures and monitoring controls accordingly.
Representing Compliance in cross-departmental meetings and projects, as well as external industry association committees.
Assisting in the development and execution of the transfer agency operations oversight framework.
Overseeing interfund trades, fund reorganizations, short term and frequent trading policy, foreign order execution, etc.
Assisting in the preparation of Funds Board and IRC reporting materials.
AssistIng with reporting and oversight of the product related complaints process and mutual funds sales practices.
A minimum of 8-10 years of relevant financial services industry experience
A minimum of 5 years in regulatory compliance or governance, risk and controls
A minimum of 3 years experience managing multiple direct reports
Solid knowledge of business operations of the investment funds and asset management industry.
Strong knowledge and understanding of regulatory guidelines, and governing legislation (i.e. NI 81-102, NI 81-105, NI 45-106, OSC Guidance, FINTRAC/FINRA, AML/ATF, PCMLTFA, PIPEDA, PIPA, PBSA, CASL, etc.).
Knowledge of relevant non-Canadian regulations is an asset.
Strong analytical skills and a high degree of attention to detail.
Strong communication and project management skills.
University degree supplemented by relevant industry courses and accreditations, or willingness to obtain (e.g. CSI Canadian Securities Course, Derivatives Fundamentals Course, ACAMS/CAMLI, etc.).
